1. Acceptance of Terms & Strict Age Restriction

By downloading, accessing, or using Sidekick the Wingman (the "App"), you agree to be bound by these Terms and Conditions. You must be strictly eighteen (18) years of age or older to use this App. By using the App, you represent and warrant that you meet this age requirement. If we determine you are under 18, your account will be terminated immediately without a refund.

2. Nature of Service & Limitation of Liability

Sidekick utilizes Artificial Intelligence to analyze screenshots and provide dating strategies, including the "Ghost Chat" feature.

  • Entertainment Purposes Only: All AI-generated advice, text, and strategies are provided for entertainment and educational purposes only. Artificial Intelligence is prone to errors, "hallucinations," and unpredictable outputs.
  • No Guarantee of Success: We make no warranties regarding romantic outcomes, matches, relationship success, or the reactions of third parties to the advice provided.
  • Total Assumption of Risk: You are solely responsible for your real-world and online interactions. To the maximum extent permitted by Australian Consumer Law (ACL), Sidekick Technology Pty Ltd disclaims all liability for any emotional distress, physical harm, reputational damage, or financial loss resulting from your use of the App or reliance on its AI-generated advice.

3. User Uploads & Third-Party Rights

When you upload screenshots containing information, images, or conversations involving third parties (e.g., other users on dating apps):

  • You represent and warrant that you have the legal right to upload such content and that doing so does not violate the Terms of Service of the platform from which the screenshot was taken.
  • Indemnification: You agree to indemnify, defend, and hold harmless Sidekick Technology Pty Ltd, its officers, and developers from any legal claims, lawsuits, or damages brought by third parties arising from your uploading of their images or private conversations to our App.

4. Payments, Subscriptions & Refunds

Sidekick offers a freemium model via rewarded ads, consumable purchases ($8.99 for 10 scans), and a recurring "Sidekick Pro" subscription ($17.99/month).

  • Billing & Auto-Renewal: Payments are charged to your Apple ID or Google Play account at the confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged $17.99 for renewal within 24 hours prior to the end of the current period.
  • Management & Cancellation: You may manage or cancel your subscription by navigating to your device's App Store Account Settings after purchase.
  • Refunds: All sales are final. We do not process refunds directly. Any refund requests must be submitted to Apple or Google and are subject to their respective refund policies.

5. Data Security & Explicit Waiver of Liability

We employ industry-standard encryption (via Supabase) and provide a 24-Hour Auto-Deletion tool to maximize your privacy. However, no electronic storage system or internet transmission is 100% secure.

  • Assumption of Risk: You acknowledge that you upload sensitive screenshots and chat logs at your own risk.
  • Waiver: In the event of an unforeseen cyberattack, unauthorized access, or data breach beyond our reasonable control, you waive your right to litigate against Sidekick Technology Pty Ltd for any resulting damages.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.

ACCEPTABLE USE POLICY

Sidekick the Wingman is designed to act as a digital assistant to help you navigate modern dating. While the App is a single-player experience, your interactions with our AI are monitored by automated safety filters. To maintain your access to the App, you must adhere to the following Zero-Tolerance rules:

1. Prohibited Content (Zero Tolerance)

You are strictly prohibited from uploading screenshots, photos, or text prompts that contain, promote, or depict:

  • Child Sexual Abuse Material (CSAM) or any content involving minors.
  • Non-consensual explicit imagery (e.g., "revenge porn") or extreme sexual violence.
  • Self-harm, suicide, or illegal acts.
  • Content intended to extort, blackmail, or scam a third party.

Violation of this rule will result in immediate, permanent account suspension without a refund, and we reserve the right to report illegal content to relevant law enforcement authorities.

2. No Harassment or Stalking

You may not use the App's "Ghost Chat" or AI analysis features to generate responses designed to stalk, harass, manipulate, emotionally abuse, or terrorize another individual. The App is an assistant for communication, not a tool for malicious psychological manipulation.

3. Privacy Best Practices

We strongly advise all users to use their device's photo-editing tools to crop out or black-out highly sensitive Personally Identifiable Information (PII) of third parties — such as full legal names, phone numbers, home addresses, or employer information — before uploading screenshots into the App.

4. Enforcement

We reserve the right to suspend or terminate any account, at our sole discretion and without notice, if we believe your use of the App violates this Acceptable Use Policy or poses a legal risk to the company.
